Mutual Contractual Termination (RC)
Since 1 April 2022, the procedure applicable in the event of a mutual contractual breach of the employment contract has evolved.
After conclusion of the termination agreement and expiration of the 15-day period during, which the parties may withdraw, the termination agreement must (now : mot à supprimer) be transmitted to the Dreets (Direction régionale de l'Economie, de l'Emploi, du Travail et des Solidarités) for approval via the dedicated website: https://www.telerc.travail.gouv.fr/accueil.
This dematerialised mode of transmission therefore becomes mandatory.
Applications for type-approval sent by post or delivered by hand to Dreets are no longer processed.
In order to avoid a procedural irregularity which would be likely to cancel the proposed breach of contract, we draw your attention to the need to comply with this new procedure.
